Motorcyclist Killed in Motorcycle Accident
On Tuesday evening another motorcyclist was killed when a car turned in front of his path on Turkey Lake Road in Orlando, Florida. According to the National Highway Traffic Safety Administration, in 2005, there were 2,128 accidents involving a motorcycle and another vehicle. In almost 40% of those accidents the other vehicle, usually a car or vehicle other than another motorcycle, was turning left while the motorcycle was going straight.
All too often, we hear about young men and women being killed in motorcyle accidents around Central Florida. The National Highway Traffic Safety Administration report on Traffic Safety Facts for 2005 reported that there were 4,553 motocyclists were killed in motorcycle accidents on the nation's roadways. In Florida, there were 469 motorcyclists killed (tied with California for the most motorcycle rider deaths in 2005). Of these deaths, 49.3% of riders were wearing a helmet. Accoridng to the report, "per vehicle mile, motorcyclists are about 34 times more likely than passenger car occupants to dies in a traffic crash."
Many times insurance companies take the position that simply because the rider was not wearing a helmet, the motorcycle rider was at fault for causing his own injuries or death. In many cases this is simply untrue. An experienced personal injury lawyer can help present the correct scenario of the facts of the accident to jurys and correct this error. Remember Florida Law requires a motorcycle rider who is under 16 years of age must wear a helmet. Riders over 21 years of age may choose not to wear a helmet provided they have an insurance policy providing at least $10,000 in medical benefits.
If you or a loved one has been involved in a motorcycle accident, the most important thing to do is to remain clam and seek immediate medical attention. Almost always, injuries from motorcycle accidents are significantly greater than injuries from car accidents. If you or your family member is involved in a motorcycle accident, you should try to collect as much information as possible such as the contact information of all witnesses, the drivers involved in the accident, exchange insurance information and make sue that the appropriate law enforcement agency prepares a written report for the motorcycle accident. Make sure to write down the details of the accident including the weather conditions, road conditions, number and types of vehicles involved in the motorcycle accident, as well as a basic diagram of the motorcycle accident. This information will be an important tool to help your attorneys to make a determination as to the cause of the accident and who may be at fault.
