How Much Is My Case Worth?
In any case there will always be individual factors to consider while evaluating a personal injury claim whether it arises from a car accident, trucking accident, slip and fall, or any other type of injuries which have been suffered through the negligence of another. At the end of the day, the value of a case will always depend entirely on the facts of the case, including both liability (who is at fault) and damages (what are your injuries). In the end a case is worth exactly how much a jury says it is worth, if the case goes to trial. Those cases which do not go to trial, but instead settle at mediation or before trial, are resolved when the parties come to an agreement about what they think a jury will or will not award at the end of trial, and the parties realize that there are risks and consequences to going to trial which may make the settlement of a case a more likely scenario.

The only way to evaluate a case to determine what it may be worth is to fully investigate the factors of the liability of the case (who is the cause of the accident or injury), determine the nature of the injuries (damages), develop the damages, research the law and then evaluate all of the other factors from the parties' background and the attorneys' experience to the venue (the county where the suit may have to be filed).

There is no single book, journal, newspaper, magazine, article or website where a personal injury attorney can go to and plug in all these factors and get a guaranteed result or answer to the question: “how much is my case worth?”

All of the facts of the case, including the type of personal injury and the cause of the negligent act of another or the recklessness of another has to be factored into the process. Then this information is filtered through the experience of the personal injury lawyer, including his background training education and experience in handling similar cases involving similar injuries.

Once that is completed, and only then, can an experienced personal injury attorney such as Mr. Cressman provide you with a range of values where your case may be valued at. However, in no event can any personal injury attorney, not even Mr. Cressman, guarantee to what your case is worth or how much money the case will settle for, or how much money a jury will award.

If anyone - especially any Attorney or Insurance Adjuster tells you exactly how much your case is worth before he knows most of these factors, or details of the liability, injuries and damages, then LOOK OUT! Either the Attorney or more especially, the Insurance Adjuster is fooling himself, or trying to fool you.
